By downloading, installing, or using FaxDaddy (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Moonstone Internet Ventures LLC ("we," "our," or "us").
FaxDaddy is a mobile application that allows users to send and receive faxes from their iPhone. The App provides document scanning, electronic signatures, fax transmission via the Public Switched Telephone Network (PSTN), delivery confirmation, a searchable directory of fax numbers, and encrypted document storage on your device.
You must be at least 13 years old to use the App. By using the App, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.
You must sign in using Sign in with Apple to create an account. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Single Fax — One-time purchase. Allows you to send one (1) fax of up to ten (10) pages. No subscription required. No dedicated fax number. No receiving capability.
Annual Plan — $79.99 per year. Includes a dedicated fax number for sending and receiving, fax transmission, delivery confirmation, and access to all App features. May include a free trial period as displayed at the time of purchase.
All purchases are processed through Apple's App Store. Subscription plans auto-renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID account settings (Settings > [Your Name] > Subscriptions). Prices may vary by region and are subject to change. Any price changes will take effect at the start of the next billing cycle.
If a free trial is offered, you will not be charged during the trial period. We will send you a reminder notification before your trial ends. If you do not cancel before the trial expires, your subscription will automatically convert to a paid plan at the displayed price. During a free trial, fax sending is limited to three (3) faxes.
Refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.
Subscription plans are described as offering unlimited faxing. To ensure service quality for all users and prevent abuse, the following fair use limits apply:
These limits apply to all plans equally unless otherwise specified. Users who require additional capacity beyond these limits may contact us at support@getfaxdaddy.com to discuss their needs.
We reserve the right to suspend or terminate accounts that engage in activity that disrupts service quality, including but not limited to: sending unsolicited faxes (fax spam), repeatedly faxing the same number in an abusive manner, or using the service for any illegal purpose.
You agree not to use the App to:
The App includes a searchable directory of fax numbers curated by FaxDaddy. This directory is provided as a convenience and is served via our API. You may not reproduce, redistribute, scrape, or extract the directory data for any purpose outside of the App. Directory data is provided "as-is" and we do not guarantee accuracy. We are not responsible for faxes sent to incorrect numbers listed in the directory. Users may submit corrections or request new numbers through the App.
Fax transmission is provided through third-party infrastructure (Telnyx) over the Public Switched Telephone Network. We do not guarantee delivery of any fax. Delivery depends on factors beyond our control, including the recipient's fax machine availability, line quality, and compatibility. We will make reasonable efforts to deliver your fax, including automatic retries for transient failures (busy signal, no answer) up to three attempts.
Delivery confirmation indicates that the fax was successfully transmitted to the recipient's fax machine. It does not confirm that the recipient has read or acted upon the fax contents.
We encrypt all documents in transit (TLS 1.3) and at rest (AES-256). Documents uploaded for faxing are stored temporarily on our servers only for the duration necessary to complete transmission. The Vault feature stores documents locally on your device and is protected by iOS Data Protection. See our Privacy Policy for complete details on our security practices.
The App, including its design, code, features, content, and branding, is the property of Moonstone Internet Ventures LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or business faxing purposes in accordance with these Terms.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY OF THE FAX DIRECTORY. WE ARE NOT A HEALTHCARE PROVIDER AND THE APP IS NOT A HIPAA-COVERED ENTITY, THOUGH WE IMPLEMENT SECURITY MEASURES CONSISTENT WITH INDUSTRY BEST PRACTICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOONSTONE INTERNET VENTURES LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Moonstone Internet Ventures LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any applicable law.
You may delete your account at any time from Settings within the App. Upon deletion, all your data will be permanently removed from our servers as described in our Privacy Policy. Active subscriptions must be canceled separately through Apple's subscription management.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the App ceases immediately.
We may modify these Terms at any time. We will notify you of material changes by posting updated Terms within the App and updating the Effective Date. Your continued use of the App after changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Los Angeles County, California.
